COACHELLA'S RADIUS CLAUSE ALLOWS ARTISTS TO GO TO ANOTHER NORTH AMERICAN FESTIVAL FOR SIX MONTHS

Due to Coachella's legal battle with the organizers of the Soul'd Out Festival in Oregon, the details of the Coachella radius clause were revealed. In a detailed report from Amplify, the whole clause is presented:

-Artists playing Coachella can not perform in North America from December 15 to May 1
-Artists are also prohibited from playing hardback concerts in Southern California during this same period.
-Artists can not "advertise, advertise, or disclose" performances at festivals in California, Nevada, Oregon, Washington, or Arizona, or So Cal headlining concerts after May 1st.
-Artists can only advertise appearances in the other 45 North American states after Coachella's January announcement, with the exception of Austin's South by Southwest, Ultra Miami and New Orleans Jazzfest supported by AEG.
-Artists also have to wait for the January announcement before airing tours in California, Arizona, Washington, and Oregon, with the exception of Las Vegas casinos, but not Las Vegas festivals.


The report states that the lawyers representing Coachella believe that this clause is necessary because it helps to "protect AEG from competition by sneaking unfairly on its creative choices by choosing its range of artists".

Apparently, the radius clause was intended only for the Soul'd Out team, so it will be interesting to see if any steps are taken regarding the publication of the document.

Should festivals be allowed to prevent artists from playing in all states of North America? We will have to wait to see what the courts say.
